Affirmative Asylum

The affirmative asylum process is for individuals who are not in removal proceedings. This Requires the applicant to be physically present in the U.S. and must be filed within one year of the date of the applicant’s last arrival in the U.S., pending certain exceptions. Applicants must demonstrate persecution or fear that they will suffer persecution due to race, religion, nationality, membership in a particular social group, or political opinion.
